Terms of Service
Effective date: October 22, 2026
1. Acceptance of These Terms
By accessing or using the Website, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Website. If you use the Website on behalf of a company or other organization, you represent that you have authority to bind that organization to these Terms.
2. Website Purpose and No Client Relationship
The Website provides general information about AI visibility, generative engine optimization, AI voice and text agents, automation, and related professional services. Website content is provided for general informational and marketing purposes and is not legal, financial, tax, accounting, cybersecurity, or other regulated professional advice.
Submitting a form, requesting an audit, scheduling a call, or communicating with us does not by itself create a client, fiduciary, partnership, employment, or agency relationship. A service engagement begins only when the parties enter into a separate written agreement or otherwise expressly confirm the engagement in writing.
3. Service Descriptions, Pricing, and Proposals
Descriptions of services, packages, deliverables, timelines, case studies, and prices on the Website are general and may change. They do not constitute a binding offer or guarantee. Final scope, fees, payment terms, responsibilities, performance standards, and other engagement terms will be stated in a separate proposal, order form, statement of work, or services agreement.
Unless expressly stated in a signed agreement, fees shown on the Website do not include third-party software, usage charges, media spend, taxes, or work outside the identified scope.
4. No Guarantee of Results
Digital marketing, search visibility, artificial-intelligence platform responses, lead generation, automation, and customer engagement outcomes depend on factors beyond our control. Examples, projections, testimonials, audit findings, and case studies are illustrative and do not guarantee rankings, citations, revenue, savings, lead volume, conversion rates, response quality, uptime, or any other result. Any commitments applicable to paid services will be limited to those expressly stated in a separate written agreement.
5. Permitted Use
You may use the Website only for lawful purposes and in accordance with these Terms. You may not:
- use the Website to violate any law or the rights of another person;
- submit false, misleading, fraudulent, unlawful, infringing, or malicious content;
- attempt to gain unauthorized access to the Website, accounts, systems, or networks;
- introduce malware, interfere with Website operation, or evade security controls;
- scrape, harvest, or collect information through automated means in a manner that burdens the Website or violates law;
- copy, republish, sell, or exploit Website content except as expressly permitted; or
- misrepresent your identity, affiliation, authority, or purpose.
6. Intellectual Property
The Website and its text, graphics, branding, logos, layouts, designs, software, and other content are owned by or licensed to Cole Digital Group and are protected by applicable intellectual-property laws. Subject to these Terms, we grant you a limited, revocable, nonexclusive, nontransferable right to access and use the Website for your internal informational and business-evaluation purposes.
No rights are granted by implication. “Cole Digital Group,” “SignalStack,” related names and logos, and any associated goodwill are owned by their respective rights holders. Other names and marks belong to their respective owners.
7. Information and Materials You Submit
You retain ownership of information and materials you submit. You grant us a nonexclusive right to use, reproduce, transmit, and process that material as reasonably necessary to respond to you, evaluate or provide requested services, operate and protect our business, and comply with law, subject to our Privacy Policy and any separate written agreement.
You represent that you have the rights and permissions needed to submit the material and that our permitted processing of it will not violate law or another party’s rights. Do not submit confidential, sensitive, regulated, or proprietary information unless we have requested it and appropriate protections are in place.
8. Communications and Marketing
When you provide contact information, you authorize us to respond to your request and send communications related to it. Where permitted by law, we may also send information about services, events, or resources that may be relevant to your business. You may opt out of marketing emails using the unsubscribe method provided in the message or by contacting us. Consent to marketing is not a condition of purchasing services.
By providing your phone number and opting in, you agree to receive text messages from Cole Digital Group related to your inquiry, including calls, appointments, and service information. Message frequency may vary. Message and data rates may apply. Reply STOP to cancel and HELP for help. Consent is not a condition of purchase. Mobile opt-in data will not be sold or shared with third parties for their marketing purposes.
9. Third-Party Services and Links
The Website may link to or integrate with third-party services, including form-processing, scheduling, communications, or social platforms. We do not control and are not responsible for third-party content, availability, security, terms, or privacy practices. A link or integration does not imply endorsement. Your use of a third-party service is governed by that provider’s terms.
10. Website Availability and Changes
We may modify, suspend, restrict, or discontinue any part of the Website at any time. We do not promise that the Website will be uninterrupted, error-free, secure, or compatible with every device or browser. We may correct errors, omissions, or outdated information without notice.
11. Disclaimer of Warranties
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE WEBSITE AND ITS CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. COLE DIGITAL GROUP DISCLAIMS IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, AND ANY WARRANTY ARISING FROM COURSE OF DEALING OR USAGE OF TRADE. SOME JURISDICTIONS DO NOT ALLOW CERTAIN DISCLAIMERS, SO PORTIONS OF THIS SECTION MAY NOT APPLY TO YOU.
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, COLE DIGITAL GROUP AND ITS OWNERS, PERSONNEL, CONTRACTORS, AFFILIATES, AND LICENSORS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS OPPORTUNITIES, ARISING FROM OR RELATING TO THE WEBSITE OR THESE TERMS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR CLAIMS ARISING FROM OR RELATING TO THE WEBSITE OR THESE TERMS WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US $100). THESE LIMITATIONS DO NOT APPLY TO LIABILITY THAT CANNOT LAWFULLY BE LIMITED OR EXCLUDED.
13. Indemnification
To the extent permitted by law, you agree to defend, indemnify, and hold harmless Cole Digital Group and its owners, personnel, contractors, and affiliates from third-party claims, damages, liabilities, losses, and reasonable costs arising from your unlawful use of the Website, your violation of these Terms, or material you submit that infringes or violates another party’s rights. This section does not require indemnification for conduct that cannot lawfully be indemnified.
14. Governing Law and Venue
These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles. Any dispute arising from or relating to the Website or these Terms must be brought in a court of competent jurisdiction located in California, and each party consents to the jurisdiction of those courts, except where applicable law requires otherwise.
15. Severability, Waiver, and Assignment
If any provision of these Terms is held unenforceable, it will be modified to the minimum extent necessary or severed, and the remaining provisions will remain in effect. A failure to enforce a provision is not a waiver. You may not assign these Terms without our prior written consent; we may assign them in connection with a reorganization, transaction, or transfer of the Website or our business.
16. Changes to These Terms
We may update these Terms by posting a revised version on this page with a new effective date. Your continued use of the Website after the revised Terms take effect constitutes acceptance of the updated Terms. If you do not agree to an update, stop using the Website.
